Any UK resident who has been injured as a result of another’s negligence. Once your injuries have been diagnosed and treated by a medical professional and you have reported the incident to the appropriate authorities, now is usually the best time to submit a claim. How much compensation will I receive? How long is a piece of string? Generally, awards of compensation depend on the seriousness of the injuries and the additional losses that have been incurred eg, loss of earnings. Once our solicitor has received the medical evidence, a valuation of the claim will then be advised. Is there a time limit for submitting a claim? Yes! A claim can be submitted up to three years from the date of the incident except in the case of Clinical Negligence, which is usually three years from the date of diagnosis. My child is under 18, can they claim? A parent or legal guardian can present a personal injury claim on behalf of those under the age of 18 years. Alternatively, a person will have three years from the date of their eighteenth birthday to submit a claim for him or herself. No win no fee arrangements are in place for the majority of incidents which means that win or lose, you should not incur any costs that have to be settled directly by you but the solicitor appointed to manage your case will advise, based on the circumstances of your claim, exactly what the costs are prior to commencing their service. There are no set time limits in place to facilitate a claim however depending on the type of incident and the extent of the injuries sustained, a good estimation can be anywhere between six months and two years to settle a claim. Other than the medical attention you have already sought, it should not be necessary to make any visits to your GP or hospital other than what you have already been advised as part of your ongoing treatment. Any treatment will be recorded on your medical records and can be used as evidence. Can I claim out of pocket expenses? In the majority of cases you should be able to claim back these expenses but it is always wise to keep all receipts as proof of the expense together with a list of what the expenses were for. If I claim against my employer, will I lose my job? Your employer cannot terminate your contract because you have submitted a personal injury claim for those workplace injuries suffered whilst at work and the law also requires your employer to have appropriate cover to insure against these instances, however depending on the extent and seriousness of your injuries, you may have to be redeployed to a different role. Do I need to travel to your offices? In most cases, we will not need to meet up, unless of course you wish to visit; all parts of the claim can be dealt with electronically, by letter or telephone.
