| Cadbury is facing the possibility of infinite fines for selling chocolate which was contaminated with salmonella.
The company which trades as Cadbury Trebor Bassett, a subsidiary of Cadbury-Schweppes, is being taken to court for selling chocolate bars and Easter eggs in 2006 whilst knowing that salmonella may be present in a chocolate crumb mixture. Lawyers and food industry chiefs have said that this case was the first time that a major brand had faced charges for failing to follow food safety controls and that the prosecutions case against Cadbury would rest on its ability to prove that it had showed “due diligence” in its business decisions. Legal action is being investigated by Irwin Mitchell solicitors on behalf of a group of 12 people who became ill after consuming one of the infected products. The solicitor in charge of the civil case, Sally Booth, has said: “The criminal prosecution is not part of the civil case but the issue of the conduct of the company is of relevance. We will be interested in the outcome.” A statement from Cadbury said: “We have fully cooperated with the authorities throughout their inquiries and we will examine the charges that have been brought.
