| Personal Injury News: HSE warning after council fined over boy’s death |
| The Health and Safety Executive has provided a warning to councils about executing its maintenance and repairs to communal areas of their properties following the death of a 13-year old boy on one of their properties.
Last week, at the Old Bailey, the London Borough of Newham was fined £125,000 together with an order for costs amounting to £6,000. The council also pleaded guilty to a further charge previously brought by the HSE of failing to sufficiently maintain communal areas of council owned flats and shops. In August 2005, Ryan Dean and his friends had been playing in Walter Hurford Parade when Ryan fell down a stairwell which had been damaged by vandals some months earlier. The investigating officer, Inspector Dominic Long said “Local Authorities have a legal obligation to ensure that tenants and other members of the public are not placed at unnecessary risk arising from poor procedures for repairing damage to buildings. This case should serve as a reminder to Councillors and Chief Executives of the importance of effective maintenance systems to ensure repairs are carried out quickly and to appropriate standards. Had such a system been in place, Ryan Dean’s death might have been prevented.” Initially the council had been informed of the damage at Easter and on five subsequent occasions over the next few months, tried and failed to repair the wall which remained incomplete. However since this time, the council has altered its procedures and these repairs are dealt with in eight hours and a follow up visit is also executed to ensure the job is finished.
